Summary:
Measuring the impact of HR activities allows practitioners to justify financial investments in attracting, retaining, and developing employees. Few practitioners, however, have a thorough understanding of the philosophy and methodology involved in developing performance indicators. This workshop will provide practitioners with an understanding of measurement philosophy as well as practical tools that can be applied to demonstrate HR performance and strategic value.

NEVADA LEGISLATURE ENLARGES OVERTIME EXEMPTION FOR
COMMISSIONED EMPLOYEES
In July, 2009, the Nevada Legislature quietly enlarged the number of employees exempt from Nevada’s overtime law. This change, exempting from overtime pay certain service industry employees earning more than half their compensation from commissions, brought Nevada’s overtime law in line with Federal overtime pay requirements. Consequently, some Nevada service industry employers may be unnecessarily paying their employees overtime pay.
NRS 608.018 provides that an employer shall pay overtime (1 ½ times an employee’s regular wage rate) when such employee works more than 40 hours per week. An employer may also be obligated to pay an employee overtime when the employee works more than 8 hours in single day. Traditionally, NRS 608.018 provided that employers need not pay overtime pay to retail employees whose total compensation was more than 1 ½ times the minimum wage, and who earn more than half their compensation from commissions. The July 2009 revision to NRS 608.018 now provides that, in addition to such retail employees, employers have no obligation to pay overtime to service employees whose total compensation is more than 1 ½ times the minimum wage, and who earn more than half their compensation from commissions. This represents a significant change for many Nevada employers.
Federal Law provides some guidance as to the type of businesses that may qualify as retail or service businesses under NRS 608.018. Such a business: (a) must engage in the making of sales of goods or services; and (b) 75 percent of its sales of goods or services, or of both, must be recognized as retail in the particular industry; and (c) not over 25 percent of its sales of goods or services, or of both, may be sales for resale. The U.S. Department of Labor has opined that the term “service establishment” must be given a meaning consistent with its usage in ordinary speech, and includes establishments such as restaurants, hotels, barber shops, and repair shops. Nevada Courts typically defer to federal overtime laws, regulations and definitions when interpreting state overtime laws.
Effective July 2009, employers have no obligation to pay overtime to retail and service employees whose total compensation is more than 1 ½ times the minimum wage, and who earn more than half their compensation from commissions. This change potentially affects thousands of service industry employees in Nevada, and may result in significant savings to qualified employers.
We are currently preparing our annual event to be held in the Fall. As soon as we have launched our 2010 Original "Best Places to Work in Southern Nevada (SM)" website, we will inform all of our loyal members, past nominees, past winners and guests. Please check out the SNHRA.org home page often for more information about this year's event.
If you would like to be among the first notified when our nomination and application forms are prepared, email admin@SNHRA.org.

The Promotion...
The boss called one of his employees into the office. "Rob," he said, "you've been with the company for a year".
"You started off in the mail room, one week later you were promoted to a sales position, and one month after that you were promoted to district manager of the sales department. Just four short months later, you were promoted to vice-president."
"Now, it's time for me to retire, and I want you to take over the company.
What do you say to that?"
"Thanks," said the employee. "Thanks?" the boss replied "Is that all you can say?"
"I suppose not," the employee said. "Thanks, Dad."
